Wholesale Beer Terms & Conditions

These Terms & Conditions (“Terms”) govern all wholesale transactions with Electric City Brewery LLC (“Brewery”) for beer purchases, whether fulfilled via pickup or shipping. By placing a wholesale order, you (“Customer”) agree to the following:

1. Order Minimums

   • All wholesale orders are subject to a 1 case or 1 keg minimum purchase.
   • Orders must be placed a minimum of 48 hours in advance for pickup or shipment scheduling.

2. Pickup Orders

   • Pickup is available Monday – Friday, 10 am – 8 pm, or Saturday – Sunday 1 pm – 5 pm.
   • Orders must be picked up within 3 days of readiness notification unless otherwise agreed.
   • Orders must be picked up by the account holder or an authorized person (the brewery must be notified of a new pickup person prior to pickup).
   • If not picked up within the timeframe, inventory will be released and restocking fees may apply.

3. Shipping Orders

   • Customer is responsible for shipping costs.
   • We are not liable for delays or damage caused during transit once the product leaves our facility.
   • Title and risk of loss transfer to the Customer upon handoff to the carrier.
   • Shipments are only made to addresses with a valid license for alcohol distribution or retail within the state of California.

4. Payment Terms

   • All invoices are due upon receipt unless net terms are approved in writing.
   • Late payments may incur a finance charge of 1.5% per month and may result in suspension of future orders.
   • Returned checks or failed payments may incur additional fees.

5. Returns & Claims

   • All sales are final. Returns are only accepted for defective products and must be reported within 48 hours of receipt.

6. Product Storage & Handling

   • Customer agrees to store all beer in a refrigerated environment unless otherwise approved.
   • Kegs and cases must be rotated and served according to freshness standards. We reserve the right to refuse future orders to accounts that mishandle our product.

7. Marketing & Branding

   • Any use of our name, logo, or artwork must be pre-approved in writing.
   • Resale of product outside of licensed premises or into third-party distribution without prior approval is strictly prohibited.

8. Keg Returns

   • Kegs remain the property of the Brewery. A refundable deposit may be charged per keg.
   • Kegs must be returned within 30 days unless otherwise agreed. Unreturned or damaged kegs may be billed at replacement cost.

9. Right to Refuse Service

   • We reserve the right to refuse or cancel wholesale orders at our sole discretion, especially for violations of these terms or abuse of privileges.

10. Modifications
